1. Who we are and what this website is

TopSurgeons.ca (the "Site") is operated by Birdseye Global Inc. ("we", "us", "our"). Yolando is a division of Birdseye Global Inc. You can contact us at [email protected].

The Site is a commercial marketing and information directory. It helps visitors find and compare surgical practices and individual practitioners in Canada, currently focused on Toronto and the Greater Toronto Area. The Site displays "Powered by Yolando", referring to the Yolando division of Birdseye Global Inc.

We are not a healthcare provider, a medical regulator, an accreditation body, a clinical assessment service or a referral service. We do not provide medical advice or personalized recommendations.

2. Accepting these Terms

These Terms of Service (the "Terms") govern your access to and use of the Site. By accessing or using the Site you agree to these Terms and to our Privacy Policy at topsurgeons.ca/privacy. If you do not agree, please do not use the Site.

The Site is intended for adults. If you are under 18 (or the age of majority where you live), you may use the Site only with the involvement of a parent or guardian.

Nothing in these Terms limits or excludes any right you have under applicable consumer protection, privacy or other laws that cannot be limited or excluded by agreement. Where these Terms conflict with such a law, the law prevails to the extent of the conflict.

3. What the Site does, and does not do

The Site lets you search and filter listed practices and practitioners, read profiles and reported qualifications, find practice contact details, read reviews imported from Google, save a shortlist in your browser and follow links to contact practices directly.

The Site is not exhaustive. It lists only some of the practices and practitioners in any area, and inclusion or exclusion does not reflect any assessment of quality. Listed practices and practitioners are independent of us unless we say otherwise (see Section 7). We do not employ, supervise, credential, inspect or control any listed practice or practitioner, and we are not responsible for their services, conduct, fees, availability or communications.

The Site does not offer appointment booking, consultations, payments or the submission of medical or personal health information. If you contact a practice through a link on the Site, you deal directly with that practice on its own terms.

4. No medical advice and no clinician relationship

The Site provides general information only. Nothing on the Site is medical advice, a diagnosis, a treatment recommendation, a second opinion or a substitute for a consultation with a qualified healthcare professional who knows your circumstances.

Using the Site does not create a physician-patient, clinician-patient or other professional relationship between you and us, or between you and any listed practitioner. Decisions about whether to have a procedure, and with whom, are yours to make with a qualified professional. Surgical and cosmetic procedures carry real risks, and results vary from person to person.

If you have a medical emergency, call 911 or go to the nearest emergency department.

5. Verify everything yourself

Information about practices and practitioners on the Site is compiled from public sources, including practice websites and public registers, and from information reported to us. We do not fact-check this information and we do not independently verify registration status, qualifications, certifications, specialties, hospital privileges, insurance, procedures offered, fees, wait times, contact details or any clinical claim.

Before relying on any listing you should independently confirm, at minimum: the practitioner's current registration and any specialty recognition with the relevant regulatory college (for physicians in Ontario, the College of Physicians and Surgeons of Ontario public register at CPSO public register); the practitioner's training and experience with the specific procedure you are considering; the practice's current address, contact details, services and fees; and whether the practitioner is suitable for your needs.

The name "TopSurgeons" is a brand name. It is not a ranking, a certification, a title or a statement about any individual. Listed practitioners have different training, registrations and specialties. Not every listed practitioner is a surgeon or holds a surgical specialty certification, and a practitioner's listing in a category does not mean the practitioner is certified in that category. Titles and specialties shown are as reported by the practitioner or as recorded in the public source we relied on; confirm them with the regulator.

6. No endorsement, no ranking, no guarantee

We do not endorse, recommend, accredit, certify or guarantee any listed practice or practitioner. Inclusion on the Site, the order in which listings appear, the prominence of a listing, a star rating, a review count, review content or a "featured" label does not mean that a practice or practitioner is better than others, has superior skill, achieves better outcomes or is right for you.

We make no promise about the competence, safety, care, results or outcomes of any practitioner or procedure. Any expectation you form from the Site about a practitioner or a procedure is yours alone.

7. Featured and commercial placement

Some listings on the Site receive priority placement, a "featured" label or other prominence. Featured practices and their practitioners appear first in directory lists, followed by the selected alphabetical order. Search, filters and shortlist selections affect which listings are shown.

Featured placement and listing order are editorial or commercial decisions. They are not based on an independent assessment of clinical quality, patient outcomes or professional standing, and they are not a recommendation. We may receive compensation from practices or practitioners in connection with the Site.

8. Reviews and ratings from Google

Reviews, star ratings and review counts shown on the Site were written by members of the public and posted on Google Maps. We did not write them. They are the personal opinions and reported experiences of their authors, not our views and not statements of fact by us. We have not verified that any reviewer was a patient, that any review is genuine, or that any statement in a review is accurate.

The reviews on the Site are a stored copy retrieved on September 27, 2026, not a live feed. A listing's reviews may be incomplete, may not be a representative sample of all reviews for that practice, and may differ from what appears on Google Maps today because reviews can be added, edited, removed or hidden at the source. Google's overall star rating and total review count are shown as they appeared at the retrieval date and are not recalculated by us from the reviews we display. Reviews are displayed newest first. All ratings are shown by default; visitors may choose a rating filter.

Ratings and reviews relate to the Google business listing for a practice. A practice's rating does not describe, and is not attributed to, any individual practitioner who works there. Where a review names or describes an individual, that is the reviewer's statement, not ours.

Reviews and ratings are provided under Google's and the reviewers' rights, not ours (see Section 12). Google is not affiliated with the Site and does not endorse it.

9. Accuracy, errors and changes

We try to keep the Site accurate but we do not promise that it is. We do not guarantee that any information on the Site, including listings, credentials, reviews and ratings, has been fact-checked or verified by us or by anyone else, and you should not assume that it has been. Information may be incomplete, out of date, mismatched or wrong. Examples include practices that have moved, closed or changed names; practitioners who have changed practices, retired or changed their registration; and a practice's listing, reviews, photographs or details being matched to the wrong practice or practitioner. Each listing shows the sources we used and the date we last checked them. That date does not mean the information is still correct.

We may add, change, correct or remove any content on the Site at any time without notice. If you spot an error, please tell us using the process in Section 14.

10. Your shortlist and your information

The shortlist feature stores your selections in your own browser. We do not receive or store your shortlist on our servers. Your shortlist will be lost if you clear your browser data or use a different browser or device.

We do not require accounts and we do not ask you for medical information. Our hosting and security infrastructure may process limited technical information, such as your IP address and browser details, when you visit. Our Privacy Policy at topsurgeons.ca/privacy explains what we collect and how we handle it.

11. Links to other websites

The Site links to practice websites, Google, regulatory registers and other third-party sites. We do not control those sites and we are not responsible for their content, accuracy, availability, privacy practices or terms. A link is provided for convenience only and is not an endorsement. When you leave the Site, the terms and privacy policy of the site you visit apply.

12. Intellectual property and third-party materials

Our content. The Site's design, layout, structure, original text, compilations, software, trademarks and logos (including "TopSurgeons" and "TopSurgeons.ca") belong to us or our licensors and are protected by copyright, trademark and other laws. You may view the Site and print or save individual pages for your own personal, non-commercial use. Automated access, crawling, scraping and bulk downloading of publicly accessible content are permitted, subject to Section 13 and the rights of third-party materials described below. This access permission does not transfer ownership or grant rights in third-party materials. Except for this permission and personal, non-commercial use, you may not otherwise copy, reproduce, republish, distribute, sell, license, frame or create derivative works from the Site or any part of it without our written permission.

Third-party materials. Practice and practitioner names, biographies, logos, photographs, portraits and other materials shown on the Site belong to the practices, practitioners, photographers or other rights holders who own them. Reviews belong to their authors. Google, Google Maps and related marks are trademarks of Google LLC. We do not claim ownership of any of these materials. They are displayed for the purpose of identifying and describing the practices and practitioners listed and are not licensed to you for any other use. Nothing on the Site grants you any right in third-party materials.

Illustrative imagery. Some images and video on the Site, including the home page reception video, are illustrative and computer-generated. They do not depict any listed practice, practitioner, patient or staff member.

No affiliation. We are not affiliated with, sponsored by or endorsed by Google or any regulatory college. Featured and commercial placement is described in Section 7.

13. Acceptable use

All crawlers and scrapers, including search-engine crawlers, AI agents and AI-training crawlers, may access the Site’s publicly accessible content. Automated access remains subject to the restrictions below.

You agree that you will not: use the Site for any unlawful purpose or in breach of these Terms; attempt to gain unauthorized access to the Site, its servers or connected systems, or test their vulnerability without our written permission; interfere with the Site's operation or impose an unreasonable load on its infrastructure; remove or alter any notice, attribution or source link on the Site; use the Site to harass, defame or harm any practitioner, practice, reviewer or other person; use any content on the Site to make decisions about an individual's eligibility for credit, insurance, employment, housing or any similar purpose; or misrepresent your affiliation with us or with any listed practice.

14. Corrections, complaints and removal requests

We want listings to be accurate and fair, and we respect the rights of practitioners, reviewers and rights holders. You may contact us at [email protected] to:

• request a correction to a listing (practices and practitioners);
• ask that a listing, biography, photograph or other material about you or your practice be updated or removed;
• ask that a review you wrote be removed from the Site, or tell us it has been edited or removed at the source (reviewers);
• report that a review or other content is inaccurate, defamatory, misleading or mismatched to the wrong practice or practitioner;
• report that content on the Site infringes copyright or other rights you hold (rights holders); or
• raise any privacy concern, including a request to stop displaying your personal information.

To help us act on your request, please include the page address, a description of the content, your relationship to it and the change you are asking for. We will review requests in good faith and may remove or amend content while we consider a request. We may ask you for information reasonably needed to confirm your identity or your rights. We do not charge any fee to consider or act on a request. Removing a review from the Site does not remove it from Google.

15. Disclaimer of warranties

The Site and everything on it are provided "as is" and "as available". To the fullest extent permitted by applicable law, we make no representations, warranties or conditions of any kind, express or implied, including any implied warranties or conditions of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, currency or reliability, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Site or its servers are free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties or conditions, so some of these exclusions may not apply to you. In that case they apply to the maximum extent permitted by the law of your jurisdiction.

16. Limitation of liability

To the fullest extent permitted by applicable law, we and our directors, officers, employees, contractors, licensors and affiliates (the "Released Parties") are not liable to you for any loss or damage arising out of or in connection with: your use of, or inability to use, the Site; your reliance on any content on the Site, including listings, credentials, reviews, ratings, ordering, featured placement, photographs and links; your selection of, communication with, or treatment by any practice or practitioner, and any consultation, procedure, outcome, complication, cost or dispute that follows; any third-party website, service or content linked from the Site; any error, omission, inaccuracy, mismatch or out-of-date information on the Site; or any interruption, unavailability, security incident or data loss affecting the Site.

To the fullest extent permitted by applicable law, the Released Parties are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data or opportunity, however caused and under any theory of liability, even if we were advised of the possibility of such damages.

To the fullest extent permitted by applicable law, and except for the matters listed below, the total aggregate liability of the Released Parties to you for all claims arising out of or in connection with the Site or these Terms is limited to the greater of (a) the amount, if any, you paid us to use the Site in the 12 months before the event giving rise to the claim, and (b) CAD $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. In particular, nothing in these Terms limits or excludes our liability for death or bodily injury caused by our negligence, for fraud or fraudulent misrepresentation, for our wilful misconduct or gross negligence, for any breach of a right you have under applicable consumer protection or privacy law that cannot be waived, or for any liability that Quebec law or other applicable law does not permit us to exclude. If you are a consumer in a jurisdiction whose law gives you rights that these Terms cannot limit, those rights are not affected.

17. Your responsibility to us

If you use the Site for a business purpose, or if you breach Section 13 (Acceptable use) or use the Site unlawfully, you agree to compensate the Released Parties for losses, damages, costs and reasonable legal fees they incur as a direct result of that breach or unlawful use, including claims made by third parties. This obligation does not apply to losses caused by our own breach of these Terms, negligence or unlawful conduct, and it does not apply to the extent it is unenforceable under the consumer protection or other law that applies to you.

18. Suspension and termination

We may restrict, suspend or block access to the Site, or to any part of it, for any visitor at any time, including where we reasonably believe these Terms have been breached or to protect the Site, its users or third parties. We may also discontinue the Site or any feature at any time. Sections 4 to 9, 12 and 15 to 21 continue to apply after any suspension, termination or discontinuation.

19. Governing law and disputes

These Terms and any dispute arising out of or relating to the Site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict of laws rules.

You agree that the courts of Ontario have jurisdiction over any dispute arising out of these Terms or the Site, and you agree to bring any claim against us in those courts. However, if the law of the province or territory where you live gives you the right to bring a claim in the courts of that province or territory, or under that law, these Terms do not take away that right.

Nothing in these Terms requires you to arbitrate a dispute, prevents you from bringing or joining a class proceeding, or prevents you from making a complaint to a regulator or consumer protection authority. If you are a resident of Quebec, any provision of these Terms that is inapplicable in Quebec under the Consumer Protection Act (Quebec) or the Civil Code of Quebec does not apply to you, and these Terms do not require you to bring a claim outside Quebec.

Before starting a legal proceeding, we ask that you contact us at [email protected] so that we can try to resolve the matter informally. This request does not affect your right to bring a claim.

20. Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they were last changed. Material changes will be indicated by a notice on the Site for a reasonable period. Your use of the Site after a change takes effect means you accept the updated Terms. Changes do not apply retroactively to any dispute that arose before the change.

21. General

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Site and replace any earlier understanding. Nothing in these Terms limits liability for fraud.

Severability. If any part of these Terms is found invalid or unenforceable in a jurisdiction, that part will be enforced to the maximum extent permitted there and the rest of these Terms will remain in effect.

No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.

Assignment. We may assign these Terms to a successor operator of the Site. You may not assign them.

Language. These Terms are provided in English. Nothing in these Terms limits any language rights that cannot be waived under applicable law.

No third-party beneficiaries. Except for the Released Parties, these Terms do not create rights for any other person.
