1. Who is responsible for your information

TopSurgeons.ca is operated by Birdseye Global Inc. Yolando is a division of Birdseye Global Inc. In this Privacy Policy, “we”, “us” and “our” refer to Birdseye Global Inc. This policy explains how information is handled when you visit the Site, appear in a listing or review, or contact us.

2. Information associated with your visit

You can browse the directory without creating an account. The Site does not offer appointment booking, payments or a patient enquiry form. We do not ask you to submit medical records, diagnoses or treatment information. Please do not include sensitive health information in searches or emails to us.

Our hosting and security providers process technical information needed to deliver and protect the Site. This may include your IP address, browser and device information, requested URLs, request times, response status and security or error information. A search submitted from the homepage can appear in the page URL and may therefore be included in request logs. We use this information to operate the Site, diagnose problems and address abuse.

If you email us, we receive your email address and whatever you include, such as your name, a page link, correction details or supporting material. We use that information to handle your enquiry, verify a request where necessary and keep a record of its resolution.

3. Practice profiles, practitioner information and Google reviews

The directory contains professional and business information obtained from public practice websites, supplied listing data and other identified sources. This includes names, biographies, reported credentials, professional photographs, practice affiliations, addresses, telephone numbers and website links.

Google review information was collected through Outscraper, a third-party data collection service, and supplied to us as an export. The Site displays a stored dataset containing reviewer display names, review text, ratings, publication dates, original review links and, where available, practice responses or supplied translations. Reviews can contain personal experiences and health-related details volunteered by their authors. We do not verify the author’s identity or patient status and do not have access to the reviewer’s medical records.

The information is displayed to help visitors research practices and practitioners. Public availability does not remove anyone’s applicable privacy rights. You may ask us to correct or remove information about you, your practice, your photograph or a review you wrote by contacting us. Our copy does not automatically reflect later edits or removals on Google.

4. Your shortlist, local storage and cookies

The shortlist feature stores the identifiers of your selected clinics or practitioners in local storage in your own browser, under the key “tst-shortlist”. These selections are not sent to or stored in our application’s server-side database. They remain in that browser until you remove the selections or clear the Site’s browser storage. They do not automatically carry over to another browser or device.

You can remove a saved listing by selecting its bookmark again. You can also clear the Site’s local storage in your browser settings. Blocking browser storage may stop the shortlist from working.

The Site currently has no advertising pixels, behavioural advertising tools or visitor analytics scripts installed by us. Our delivery and security providers may use cookies or similar technologies when necessary to deliver their services or respond to suspicious traffic. Those providers describe their practices in the policies linked below.

5. How information is used and disclosed

We use information to publish and maintain the directory, deliver requested pages, operate browser-based features, respond to correspondence, correct records, address removal or privacy requests, protect the Site and meet applicable legal requirements. We do not use your shortlist to create a server-side patient profile.

We use service providers for hosting, content delivery, security and communications. Railway hosts the application, and Cloudflare provides traffic delivery and security services. These services may process technical request information. See the Railway Privacy Policy and Cloudflare Privacy Policy for information about their respective practices.

We may disclose information where required or permitted by applicable law, to respond to lawful requests, to establish or defend legal claims, or to protect rights and security. If the Site is transferred to another operator, personal information may be transferred as part of that transaction subject to applicable law.

Publicly displayed listings and reviews can be accessed by anyone. The Site permits crawling and scraping, including by search engines, AI agents and AI-training crawlers. As a result, public content may be copied or processed by third parties. This permission does not give third parties ownership of the content or excuse them from applicable law or rights. We do not control how independent third parties retain their copies.

6. Processing outside Canada

Our service providers may process or store information in Canada, the United States or other countries in which they or their service providers operate. Information processed outside Canada may be subject to the laws of that country and lawful access by its courts or authorities. Contact us if you would like more information about our service providers or cross-border handling.

7. Retention and safeguards

We retain personal information only for as long as reasonably needed for the purposes described in this policy, including responding to requests, maintaining directory records, meeting legal obligations and resolving disputes. Retention periods depend on the information and purpose; there is no single retention period for every record. Technical logs and backup copies may also be subject to service-provider retention processes.

When information is no longer needed, we will delete it or remove identifying details, subject to legal requirements and reasonable backup or security processes. Removing content from our Site does not delete it from Google, the original practice website, search-engine caches or independent third-party copies.

We use technical and organizational measures intended to protect information in our control, including encrypted website connections and restricted administrative access. No website, email system or storage method can be guaranteed completely secure. We will handle security incidents and any required notices in accordance with applicable law.

8. Your choices, access, correction and removal requests

You may ask what personal information we hold about you, request access or a correction, raise a concern about its use, or request removal of information displayed about you. Where processing depends on your consent, you may ask to withdraw it, subject to applicable legal or contractual restrictions. Some information may need to be retained for legal, security or dispute-resolution purposes.

Email [email protected], including the relevant page URL, your relationship to the information and the change or information you are requesting. Provide only what is needed to explain the request. Do not send identity documents or medical records unless we specifically explain why particular information is reasonably necessary.

We may ask for reasonable information to verify your identity or authority before disclosing or changing information. We will respond within the period required by applicable law and explain any refusal or permitted extension. There is no fee to submit a correction, complaint or removal request. If we cannot resolve your concern, you may contact the Office of the Privacy Commissioner of Canada or the applicable provincial privacy authority.

9. Children and health information

The directory is intended for adults researching practices and practitioners. We do not operate patient accounts or knowingly solicit personal information directly from children. If you believe the Site displays a child’s personal information inappropriately, please contact us so we can review it.

Please direct clinical questions, appointment enquiries and medical information to your healthcare provider, not to this directory. Public reviews may discuss health experiences, but the Site is not a medical-record system or a way to communicate confidentially with a clinician.

10. Links and contact with practices

Links to practice websites, Google Maps, regulatory registers and other services take you to independently operated websites. Those websites have their own privacy practices. If you call, email or otherwise contact a practice, you are communicating with that practice directly. We do not receive the contents of those communications through the Site.

11. Changes to this policy

We may update this policy when our services or information-handling practices change. The date at the top identifies the latest update. We will provide appropriate notice of material changes and obtain consent where required by applicable law.
